2009年中美轮胎特保案是中国入世以来美国第一次运用“特保条款”对中国产品征收惩罚性关税。研究该案案情的来龙去脉,在当前金融危机引发新一轮贸易保护主义浪潮的背景下,具有鲜明的时代意义;而探索积极有效的法律对策,是妥善解决国际贸易摩擦的重要举措。特保条款本身就具有歧视性和不公正性,通过对美国国际贸易委员会裁决的法律分析,可以断定,美国这种贸易保护主义的做法不仅违反了世贸组织法的相关规定,而且违背了自由贸易原则,是对世贸组织特保条款的滥用。
The Sino-U.S. Tire Spread in 2009 is the first time that the United States has applied “special safeguard clause” to impose punitive tariffs on Chinese products since China’s accession to the WTO. The study of the circumstances surrounding the case has a clear epochal significance in the current context of the new wave of trade protectionism triggered by the financial crisis. To explore a positive and effective legal response is an important measure for properly resolving international trade frictions. The safeguard clause itself is discriminatory and unfair. Judging by the legal analysis of the ITC decision, it can be concluded that this U.S. trade protectionism not only violates the relevant provisions of WTO law, but also violates the principle of free trade The principle is the abuse of the WTO safeguard clause.
