自由社会既信奉法治,又尊崇自治。换句话说,一个自由的社会既是一个法治社会,又是一个自治社会。那么,如何确保一个社会既是法治的又是自治的?法治与自治之间的关联究竟是什么?这种关联如何造就一个多中心的秩序?对这些问题的回答有助于发展自由社会的一般理论,探究确立一个自由社会的逻辑和制度基础。从辨析法治和自治的要义与原理入手,考察法治和自治的规则要求,澄清二者之间的内在关联,透视它们如何共同作用于一个多中心的社会秩序。
Free society not only believes in the rule of law, but also respects autonomy. In other words, a free society is both a law-based society and an autonomous society. So how can we ensure that a society is both a law and an autonomous one? What is the connection between the rule of law and autonomy? How does such a relationship create a multi-center order? The answers to these questions help to develop the general theory of a free society , Exploring the logical and institutional basis for establishing a free society. Starting with the analysis of the essence and principle of the rule of law and autonomy, this article examines the rule requirements of the rule of law and autonomy, clarifies the intrinsic connection between the two and reveals how they all work together in a multi-center social order.
