【裁判要旨】实践中,被执行人与案外人虚构租赁关系规避执行的情形愈演愈烈,通过异议审查程序对租赁关系的真实性进行有限的实体审查是反规避执行的重要手段。审查中可将租赁权合法有效的证明责任分配给承租人,并可将租赁合同签订的时间、租金支付的方式、承租人是否实际占有租赁物、被执行人和承租人之间的关系以及承租人在法庭上的表现等因素作为形成心证的参考。
