从项目治理的角度分析我国建筑市场管理制度中存在的问题,针对草拟中的《建筑市场管理条例》提出若干立法建议。研究表明,在建筑市场的诸多矛盾中,对建设项目的治理是主要矛盾;在建设项目的诸多利益主体中,建设单位是矛盾的主要方面。建设单位的行为规范问题,最终可以归结为项目法人的定位以及剩余控制权与剩余索取权的合理配置问题。对政府投资和非政府投资两种类型的建设项目采取“一手抓、一手放”的方针,这样对前一类项目有利于减少腐败行为和工程质量事故,对后一类项目有利于提高效率。
From the perspective of project management, this paper analyzes the problems existing in the management system of construction market in our country and puts forward some legislative proposals in light of the “Construction Market Management Regulations”. The research shows that among the many contradictions in the construction market, the governance of construction projects is the main contradiction; of the many stakeholders in construction projects, the construction units are the major contradictions. The code of conduct of the construction unit can be attributed ultimately to the positioning of the project legal person and the issue of the rational allocation of residual control rights and residual claims. For the two types of government investment projects and non-government investment projects to take “one hand and one hand release” approach, so the former project is conducive to reducing corruption and engineering quality accidents, the latter type of project is conducive to increase effectiveness.
