中国的法律体系以及中国民众的权利意识,不仅受到儒法传统的影响,也受到现代个人主义和消费主义潮流的冲击。文章认为在此语境下,关于性骚扰立法的叙事,无论叙事者是知识精英,还是草根民众,注定要成为一场后现代的权利批判叙事,同时挑战前现代的男性-权力本位叙事和现代的权利话语迷思。这一剧烈社会变革中的性骚扰叙事,涉及文化、权力与市场等多样化的语境和立法、救济、赋能等关键词。
China’s legal system and the Chinese people’s awareness of their rights are not only affected by the Confucian and legal traditions but also by modern individualism and consumerism. In this context, the article holds that the narrative about sexual harassment legislation is bound to become a post-modern right to criticize the narrative, whether the narrator is the intellectual elite or the grassroots. At the same time, it challenges the pre-modern masculinity - the power-based narrative and the modern Right discourse myth. The narrative of sexual harassment in this dramatic social change involves a variety of contexts such as culture, power and markets, and legislation, remedies, empowerment and other key words.
