作为典型的舶来品,慕课正在我国高校法学课堂广泛运用。从法学的角度分析,慕课法律关系的主体包括慕课演绎者、传播者与受益者。慕课的演绎、传播与著作权的合理使用制度有着密切的关系。文章认为现有的合理使用制度在一定程度上阻碍了慕课的成长,可以从放宽合理使用制度标准、扩大课堂认定范围并采取技术控制措施等,促进慕课教育模式发展。
As a typical exotic, Mousu is widely used in Chinese law schools. From the perspective of jurisprudence, the main body of the legal relationship of Mucha consists of Mucha class interpreter, communicator and beneficiary. Mutilation, interpretation and dissemination of copyright and the rational use of the system has a close relationship. The article holds that the existing system of fair use hinders the growth of Mok class to a certain extent, and it can promote the development of Mok class of educational modes by relaxing the system of fair use, expanding the scope of class recognition and adopting technical control measures.
