地下空间权产生于城市化发展与土地集约化利用的双重需求。西方典型国家立法中存在实质意义上的空间权制度,我国物权法及相关立法没有确立此具体制度,无法为城市化发展利用地下空间提供法律规范,不利于地下空间有序有效利用。笔者认为应构建地下空间权制度,明确其登记取得方式、登记管理部门以及权利人的优先权等诸问题。
Underground space rights arise from the dual needs of urbanization and intensified land use. There is a substantive space right system in the typical Western national legislation. China’s real right law and related legislation do not establish such a specific system and can not provide legal norms for urbanization and utilization of underground space, which is not conducive to the orderly and effective utilization of underground space. The author believes that the system of underground space right should be constructed, and the problems such as the way of obtaining the registration, the registration administration department and the priority of the right holder should be clarified.
