公安信访作为信访制度的一部分,因公安工作机制和公安业务的特殊性,与其他国家机关的信访制度有别。当前国务院《信访条例》作为信访制度的纲领性法规,未考虑到公安行政职权与刑事司法职权的功能分野和定位区别;加之公安部门的程序性规章未明确其信访职能在各职权领域中的定位,使公安信访在制度构架和操作层面均出现功能性偏差,进而影响公安机关行政与刑事职能的完整有效落实,公安信访自身也陷入困境。将公安信访制度在行政领域的定位转移至信息反馈和效能评估机制功能的实现,在刑事司法领域的定位转移至咨询机制的推行,将更好地解决公安信访制度自身效力低下,信访机制与其他执法程序不能匹配等问题。进行上述工作的先行步骤应从制度“顶层”入手,通过警察组织法、任务法和程序法的完善,对信访机制在公安机关内部位置的重新安排、功能和程序的重新调整作出系统性的解决。
As a part of the letter and visit system, the public security petition system is different from the letter and visit system of other state organs because of the particularity of public security work mechanism and public security business. Public security petitions themselves are also in trouble. The transfer of the public security petition system in the administrative field to the function of information feedback and performance evaluation mechanism and the transfer of its position in the field of criminal justice to the implementation of the advisory mechanism will better solve the problem that the public security petition system itself is ineffective and that the petition mechanism and other Law enforcement procedures can not match other issues. The first steps to carry out the above work should start with the system “top level ”, and through the consummation of the police organization law, the task law and the procedural law, systematically make the resettlement of the petition mechanism within the public security organs and the readjustment of functions and procedures solve.
