增强利用权是相对一般利用者利用公物的权利而言的,它是公物附近居民基于日常生活和工作需要而依法享有的可以超出一般利用范围和程度而利用公物的权利。此项权利只在合理利用的范围内才存在,其具体内容需要根据公物类型、当地利用习惯、依赖利用的范围、增强利用的必要性等因素进行综合判断后予以确定。鉴于现行法律基本没有规范增强利用权,国家应在相关立法中确认公物利用习惯是公物法的渊源,在公物立法上确认增强利用权并给予特别保护,尤其应当为其提供必要的程序保障与救济途径,如授权地方政府代表公物附近居民主张增强利用权的资格等。
The enhancement of the right of utilization is relative to the right of ordinary users to use the public property.
