权利和义务的对应性

对应性这一形式性的关系把每一种道德权利和一种道德义务联系起来,把每一种道德义务和一种道德权利联系起来;权利和义务符合于责任的交易模型。这种形式性的对应关系对于后天获得的权利和义务来说是有效的,对于无需后天获得而拥有的权利和义务来说也是有效的。有三个对对应性论题的重要挑战,第一个挑战是:如果我们接受这个论题,我们就不得不说,动物一般地可以负有对人的义务了;第二个挑战来自于与索赔权相对的“自由权”;第三个挑战是基于康德和约翰·斯图亚特·密尔所说的不完全义务,或关于不完全责任的义务。作者应对了这三个挑战,并表明所谓的不完全义务是有条件限制的义务,它们有与之对应的权利。对应性原则也适用于有条件的和无条件的道德权利。有条件权利在形式上与有条件义务相联系;无条件权利——无论是绝对的还是相对的——在形式上与无条件义务相联系。 The formal relationship of correspondence links every moral right with a moral obligation, linking each moral obligation with a moral right; rights and obligations conform to the trading model of responsibility. This formal correspondence is valid for the acquired rights and obligations and is also valid for the rights and obligations acquired without being acquired. There are three important challenges to the correspondence thesis. The first is that if we accept the thesis, we have to say that the animals can generally bear the obligation to human beings. The second challenge comes from being opposed to the right to claim The third challenge is based on the incomplete obligations of Kant and John Stuart Mill or about the obligation of partial responsibility. The author addresses these three challenges and shows that so-called partial obligations are obligations that are conditionally limited and that they have corresponding rights. The principle of correspondence also applies to moral rights that are conditional and unconditional. Conditional rights are formally linked to conditional obligations; unconditional rights - both absolute and relative - are formally linked to unconditional obligations.
