英美法系和大陆法系对受益人的救济权有着不同的规定,英美信托法在衡平法上赋予受益人追踪权,由于没有衡平法和普通法的地区分,大陆法系国家只规定了受益人撤销权。本文通过对受益人撤销权的法律性质、行使条件以及行使后的法律后果进行探究,以期能更好的保护信托受益人的受益权,促进我国信托业的蓬勃发展。
The Anglo-American legal system and the civil law system have different provisions on the relief rights of the beneficiaries.
