新的交通安全法出台后,引起争议最大的就是关于机动车和行人之间发生交通事故的责任承担和赔偿。从“归责原则”说“机动车”机动车属于高速运输工具,根据《民法通则》第一百二十三条规定,机动车驾驶人应该承担无过错责任。无过错责任的产生,缘于人们试图寻找一种较之传统过错责任原则更为严格的法律,以便对受害人提供保护和救济。德国人最先发明汽车,对于汽车所引起的道路交通事故也以其独特的严谨思维、深邃的法理思想率先立法确立无过错责任归责原则。
After the promulgation of the new Traffic Safety Law, the most controversial issue is the liability and compensation for traffic accidents between motor vehicles and pedestrians. From the principle of attribution, motor vehicles belong to high-speed means of transport. According to Article 123 of the General Principles of Civil Law, motor vehicle drivers should assume no fault liability. The emergence of no-fault liability arises from the attempt to find a law that is stricter than the traditional principle of fault liability in order to provide protection and relief to victims. The Germans first invented the automobile, and also took the lead in legislation to establish the principle of no-fault liability for the road traffic accident caused by the automobile with its unique and rigorous thinking and profound jurisprudence.
