国际社会区别于国内社会的本质特征在于无政府性质,国际法是西方法哲学传统在这一无政府社会的规范建构:契约和习惯在西方法学中有着重要的造法地位,国际法形式渊源主要表现为条约和习惯法,与西方法学对“法”的认识存在路径依赖性。然而,国际法与国内法不同,国际法形式渊源背后并没有权威立法机制支撑,国际法的形式渊源理论不能暗示国际法规则的合法性和效力位阶。国际法形式渊源理论仅仅是司法过程中确认国家同意的一种法律技术,是人们认识国际法的一种习惯路径,并不意味着国际法本身的存在形式。也就是说,国际法形式渊源理论不是国际法的本体论,而是认识论。
The essential feature of the international society distinguished from the domestic society lies in its anarchic character. International law is the normative construction of the Western legal philosophical tradition in this anarchy society. Contract and custom have an important status in the jurisprudence of Western law. The formal sources of the international law are mainly Treaties and customary law, there is a path dependence with western legal science “law ” understanding. However, international law differs from domestic law in that there is no authoritative legislative mechanism behind the formal origin of international law. The formal origin theory of international law can not imply the legitimacy and effectiveness of the rules of international law. The theory of formal origin of international law is only a legal technique for confirming the consent of the state in the judicial process. It is a customary route for people to understand international law and does not mean the existence form of international law itself. In other words, the formal origin theory of international law is not the ontology of international law, but epistemology.
