案情简介2010年3月,业主委员会B委托招标代理公司C就某物业管理服务进行招标,三家物业公司参加投标,最终物业公司A成为第一中标候选人。此后,业主委员会B却与排名第三的物业公司签订物业管理服务合同。物业公司A认为,双方之间的招投标行为合法有效,业主委员会B与招标代理公司C恶意串通并与排名第三的物业公司签订物业管理合同侵害了自己的利益。据此,物业公司A将业主委员会B起诉至法院,要求业主委员会B承担违约责任,双倍返还投标保证金。
Brief introduction of the case In March 2010, Committee B of the Owner commissioned the Tendering Agent Company C to bid for a property management service. Three property companies participated in the bidding and eventually Property Company A became the first successful candidate. Since then, the owners of the Committee B has signed with the third property company property management services contract. Property company A believes that the bidding between the two parties is legal and valid, and the owners’ committee B and the bidding agency C malicious collusion and sign the property management contract with the third-ranked property company infringe their own interests. Accordingly, the property company A sued the owners ’committee B to the court and asked the owners’ committee B to assume the liability for breach of contract and double the bid bond.
