反环保运动对美国环境政策和法律的影响颇为深远,却甚少受到国内的关注。反环保运动贯穿于环保立法、执法的始终,在二十世纪八、九十年代达到顶峰。反环保运动形成的因素包括美国三权分立的宪政体制、私有产权等等。环保试图调整人与自然的关系,赋予自然类似于人的权利才是反环保运动成为一种社会势力的最根本原因所在。反环保运动使得法院在环境问题上由同情、支持态度向谨慎态度转移,直接的后果就是公众环保观点模糊化,最终使得美国环境政策和法律难以深化。
The anti-environmental campaign has far-reaching effects on U.S. environmental policies and laws, but seldom receives domestic attention. Anti-environmental protection campaign runs through environmental legislation, law enforcement has always been in the twentieth century, eight, nineties. Anti-environmental movement formed factors include the constitutional system of the United States, the separation of powers, private property rights and so on. Environmental protection attempts to adjust the relationship between man and nature, giving nature a similar human rights is the most fundamental reason why the anti-environmental protection movement has become a social force. Anti-environmental movement makes the court from the sympathetic and supportive attitude to the cautious attitude transfer on environmental issues, the direct consequence of which is the obscure view of public environmental protection, which ultimately makes the United States environmental policy and law is difficult to deepen.
