未经过宪法修改程序而发生的宪法变动,形成了宪法学意义的宪法变迁,旨在调和宪法规范、宪法现实和宪法价值之间的冲突和适应关系。源自美国宪法理论的“活的宪法”强调宪法的动态性,与其异曲同工。其理论意义在于为公权力行为的合宪性提供一个丰富的方法论。国际组织因履行其宗旨和职能,需要适应不断发展的国际时势和情势,具有宪法变迁的充分可能性和可行性。国际组织的宪法变迁原理,涉及其内涵和形式、国际组织的宪法解释、国际组织的宪法惯例、合法条件和界限等面向。宪法变迁是国家宪法变动的非正式方法,却是国际组织宪法成长的必须要求和必然过程。由于一般缺乏宪法解释权,国际组织的宪法变迁以宪法惯例或宪法习惯法为主要形式,国际司法机构的解释在性质上通常也是一种宪法惯例。国际组织的宪法变迁原理有助于国际组织法基础理论的研究,并揭示宪法也可能随着国际共同体整合之进程而在国际组织中生成和变迁,因而创新传统宪法产生背景之理论。
The constitutional changes that have taken place without the constitutional amendment process have led to constitutional changes in constitutional law aimed at reconciling the conflicts and adaptation between constitutional norms, constitutional realities and constitutional values. The “living constitution” originating from the theory of constitutionalism in the United States emphasizes the dynamism of the constitution and has the same features as the other. Its theoretical significance is to provide a rich methodology for the constitutionality of public power behavior. To fulfill their purposes and functions, international organizations need to adapt to the evolving international times and situations and have the full possibility and possibility of constitutional changes. The principle of constitutional change in international organizations involves its connotation and form, the constitutional interpretation of international organizations, the constitutional conventions of international organizations, legal conditions and boundaries. The constitutional change is an informal method of the constitutional change of the state, but it is a necessary and inevitable process for the constitutional development of an international organization. Due to the general lack of the power of constitutional interpretation, the constitutional changes in international organizations are mainly constitutional conventions or constitutional customary law, and the interpretation of international judicial bodies is also generally a constitutional convention in nature. The principle of constitutional changes of international organizations helps to study the basic theory of international organizations law and reveals that the constitution may also be generated and changed in international organizations along with the process of international community integration.
