随着我国法治进程的加快,国民的法律维权意识不断加强,对知识产权的保护意识也不断增强。近年来,社会上出现了不少商标侵权的案例,“滴滴打车”商标侵权案就是在日益盛行的互联网预约租车业务背景下的一起案例。在《商标法(2013年修正)》之前,国内学者有不同的看法,对在先使用商标是否应该加以保护,司法实践也有不同的判决,我国在此类问题上立法还不够完善。但是我们应当明确,对商标的保护是市场正常秩序的重要保障,我们不应僵化地固守“注册在先”原则,应对在先使用商标的所有人付出的智力劳动进行相应法律保护。本论文以《商标法(2013年修正)》为切入点,以“滴滴打车”商标侵权案为背景,剖析当前关于在先使用商标保护的相关法律及制度建设。结合我国现行法律规定,从完善立法的角度探讨我国对在先使用商标保护的必要性,并提出合理化建议,以保证我国对商标知识产权的重视,从而推动我国市场经济健康有序运行。
With the acceleration of the process of rule of law in our country, people’s awareness of legal protection of their rights has been continuously strengthened and awareness of the protection of intellectual property has also been constantly enhanced. In recent years, there have been many cases of trademark infringement in the society. The case of trademark infringement is a case in the context of an increasingly prevalent Internet booking car rental business. Before the “Trademark Law (Amendment of 2013)”, domestic scholars had different opinions on whether the prior use of trademarks should be protected or that judiciary practices also had different rulings. Our country’s legislation on such issues is not yet perfect. However, we should make it clear that the protection of trademarks is an important guarantee for the normal order of the market. We should not rigidly stick to the principle of “registration first” and should correspondingly protect the intellectual work of the owners who have previously used the trademark. Based on the “Trademark Law (Amendment of 2013)” as the starting point and the case of trademark infringement as the background, this paper analyzes the current law and system concerning the prior use of trademark protection. In combination with the current laws and regulations in our country, this paper discusses the necessity of trademark protection in our country from the view of perfecting the legislation and puts forward reasonable suggestions to ensure that our country pays more attention to the trademark intellectual property and promotes the healthy and orderly operation of market economy in our country.
