本文以对现在论述知识产权合理性问题的主流观点的批判为形式,分析了劳动财产论、科技发展论在解释知识产权合理性和发展过程问题中存在的缺陷。本文认为,在我们承认资本和市场经济合理性的前提下,知识产权的合理性在于资本对于垄断利润的追逐。承认这一点,是基于对知识产权发展历程的分析以及市场经济模式下知识作为商品运转的过程的分析。同样基于这一分析,本文指出了发展中国家在引进知识产权制度时面临的两难困境。同时,本文指出,特权这一封建法权在知识产权制度的形成过程中起到了不可替代的作用,但封建特权如果缺乏市场经济模式的冲击,并不必然转化为现代知识产权法律制度。
Based on the criticism of the mainstream view of the rationality of intellectual property nowadays, this article analyzes the defects of labor property and science and technology development in explaining the rationality and development process of intellectual property. This paper argues that under the precondition that we recognize the rationality of capital and market economy, the rationality of intellectual property lies in the pursuit of monopoly profit by capital. This recognition is based on the analysis of the development of intellectual property and the analysis of the process of knowledge as a commodity in a market economy. Also based on this analysis, this article points out the dilemma facing developing countries in introducing the system of intellectual property. At the same time, this paper points out that the feudal legal privilege played an irreplaceable role in the formation of the intellectual property system. However, if feudal privileges were not impacted by the market economy, it would not necessarily be transformed into the modern legal system of intellectual property.
