最近全国各地出租车司机罢工现象频发,引起了社会各界的关注。本文拟从此社会现象出发,从司机的份子钱与工资、罢工的性质以及出租车行业的性质三个角度切入,在竞争法语境下,先用经济学原理分析上述三个问题,再试讨论现行法律体系对于上述三个问题的适用可能性。最终通过应然和实然的比较,提出自己的建议。
