香港非营利组织对于内地社会福利事业发展做出了很大贡献。由于内地缺少相应的法律规定,香港非营利组织在内地的活动尚有合法性的疑问,另外,内地与香港关于非营利组织的分类、登记、管理等诸多问题存有差异,从而为某些内地组织或外国社会组织寻求在香港转换主体身份提供了便利,也为某些社团式香港公司来内地进行营利活动创造了机会,因此探讨香港非营利组织在内地活动的合法性尤为重要。本文以两地法律冲突为研究基础从区际私法角度探讨了活动合法性的法律适用原则。
Hong Kong non-profit organizations have made great contributions to the development of social welfare in the Mainland. Due to the lack of corresponding legal provisions in the Mainland, Hong Kong non-profit organizations still have questions about the legitimacy of their activities in the Mainland. In addition, there are differences between the Mainland and Hong Kong regarding the classification, registration and management of non-profit organizations and many other issues, As organizations or foreign social organizations seek to facilitate the transfer of principal status in Hong Kong, they also create opportunities for certain corporate Hong Kong companies to make profits in the Mainland. Therefore, it is particularly important to explore the legitimacy of Hong Kong non-profit organizations in the Mainland. Based on the conflict of laws between the two places, this article explores the principle of law applicable to the legitimacy of activities from the perspective of interregional private law.
