在现代民主与法治社会,法律援助是法治制度中体现对弱势群体民众人性关怀的一个重要方面。当处于贫、弱境地的公民遇到涉及法律事务纠纷时,往往由于经济困难或处于弱势群体,而难以自我进行法律保护。有鉴于此,政府与民间非官方团体均建立了相应的法律援助机构,对这些贫弱者给予法律方面的减、免费用的帮助,以保护贫弱者的合法权益。法律援助是法律所明确规定的政府义务,也是以政府行为作为主导。而民间法律援助则具有地区性与专向性特点。总体而言,民间法律援助是对政府法律援助的很好补充,能够帮助、促使政府更好地履行法律援助的义务与职责,从而使得每个公民都能在法律制度下获得平等对待,以促进社会和谐发展。
In modern democracy and the rule of law, legal aid is an important aspect of the human rights concern for the underprivileged people in the legal system. When the citizens in the poor and vulnerable situations encounter disputes involving legal affairs, they often find it hard to protect themselves because of financial difficulties or the disadvantaged groups. In view of this, both the government and non-governmental non-governmental organizations have established corresponding legal aid agencies to give legal aid to these poor and poor people and help them with free assistance to protect the legitimate rights and interests of the infirm. Legal aid is a government obligation clearly laid down by law and is also dominated by government action. Private legal aid has the characteristics of both regional and specialization.
