名人代言虚假食品广告行为具有严重的社会危害性,追究名人刑事责任极为必要。最高人民法院和最高人民检察院的刑事司法解释将名人代言虚假食品广告行为定性为生产销售类犯罪的共犯,为追究该类名人的刑事责任提供了一定的法律依据,但还不够全面,因为名人代言虚假食品系行为类型,可能涉嫌不同罪名。作为一种行为类型,名人代言虚假食品广告行为可以构成虚假广告罪和生产销售类犯罪的共犯,在欺骗性广告中,若造成消费者财产损失也可以构成诈骗罪。
Celebrity endorsement of fake food advertising has serious social harmfulness, investigating the criminal liability of celebrities is extremely necessary. The Supreme People’s Court and the Supreme People’s Procuratorate criminal justice interpretation of the celebrity endorsement of false food advertising act as an accomplice in the production and marketing of crimes for the prosecution of such celebrities to provide a legal basis for criminal liability, but not comprehensive enough, because celebrity endorsements False food line type of behavior may be suspected of different charges. As a type of behavior, celebrity endorsement of false food advertising behavior can constitute a crime of false advertising and sales of crime accomplices in fraudulent advertising, if the loss of consumer property can also constitute fraud.
