在法官遴选时,对法官候选人的考察主要包括法律专业知识、法律职业技能、法律职业道德等方面的素质。其中,对于法官候选人的道德考察存在着理论上和实践上的诸多困境,主要包括道德标准、考察主体、考察对象、考察方法等几个方面。通过对这些困境的反思,可以得出如下启示:转变过分强调法官遴选中道德考察的态度;以法定的消极考察作为无法进行积极有效的道德考察的弥补;强调法官遴选后的道德建设和道德监督。
When the judge is selected, the investigation of the candidate for the judge mainly includes the legal professional knowledge, legal professional skills, legal professional ethics and other qualities. Among them, there are many predicaments in the moral investigation of the candidates for the judges in theory and practice, including the moral standards, the subjects, the objects of study and the methods of investigation. Through the reflection on these dilemmas, the following enlightenment can be drawn: the change emphasizes the attitude of moral investigation in the selection of judges; the legal negative inspection can not make up for the positive and effective moral investigation; the moral construction and moral supervision after the selection of judges .
