《论法的精神》是孟德斯鸠一生重要的著作,伏尔泰将此书推崇为“理性和自由的法典”。它不仅为法国和其他国家的资产阶级提供了理论武器,而且也为资产阶级国家和法律制度的建立提供了模式和原则,追求自由、主张法治、实行分权的理论。笔者从孟德斯鸠著书目的入手,对《论法的精神》进行浅析。 “The Spirit of Law” is a monumental work of Montesquieu’s life, and Voltaire praises the book as “the code of reason and freedom.” It not only provided theoretical weapons to the bourgeoisie in France and other countries, but also provided models and principles for the establishment of bourgeois countries and legal systems, pursued the principles of freedom, advocating the rule of law and decentralization.
