近年来,随着我国城市化进程的加快以及国家对土地的分区控制和用途管制,土地发展权尤其是农地发展权的缺位导致农地保护成效差、农地增值收益分配不公、农地资源配置效率低下等一系列矛盾和问题,农地发展权逐渐被社会各利益主体所认识和重视。本文采用文献资料法和比较分析法,对农地发展权的涵义、农地发展权的归属以及常用的农地发展权价值评估方法与补偿等问题进行了总结评述,以期为农地发展权理论的拓展提供参考。
