哈萨克是我国古代西北游牧民族的后裔。其族源可追溯至西汉时期的塞种、月氏、乌孙、康居、匈奴及以后的突厥、葛逻禄、哈喇契丹、克烈、乃蛮、钦察等。在悠久的历史发展进程中,他们形成了世代相传的习惯法。哈萨克汗国建立后,又制定一系列法典、条例。因此,对十六世纪至二十世纪初的哈萨克法进行探讨,将有助于其社会历史及物质文化、精神文化的深入研究。
Kazakhstan is a descendant of the ancient nomadic peoples in northwestern China. Its origin can be traced back to the Western Han Dynasty Cypriots, the month’s, Wusun, Kangju, Huns and later Turkic, Geluo Lu, Khora Khitan, Ke Lie, Naimi, Qincha and so on. In the course of their long history, they formed the customary law handed down from generation to generation. After the establishment of Kazakh Khanate, it has formulated a series of codes and ordinances. Therefore, the discussion of the Kazakh law from the 16th century to the beginning of the 20th century will contribute to the further study of its social, historical, material and spiritual cultures.
