《中华人民共和国物权法》已于10月1日开始施行,尽管该法第七十四条对建筑区划内的车库(位)作了规定,但仍然存在着相关法律法规不配套、不健全的矛盾,审判实践中仍会面对不少现实而棘手的问题。为促进实务领域对相关问题的深入思考和研究,正确理解、把握、适用好物权法相关条文,本刊于9月22日在南京召开了“城市机动车停车库(位)法律问题”理论与实务研讨会,来自全国部分省、市的法官、律师、专家和学者在研讨会上进行了热烈的交流,现摘登部分发言,以飨读者。
