近代以来,随着科技的高速发展以及世界各国都市化程度的不断提高,城市的土地资源日显稀缺和珍贵,地下空间已经成为人类生活拓展的新领域,它不再附属于地表,而是具有了独立的经济价值和权利,我国《物权法》第136条也明确了地下空间的用益物权性质,但与地下空间开发利用的发展实践相联系,目前立法仍存在漏洞与不完善。本文从地下空间权作为物权的合理性与科学性出发,提出建立和完善该项法律制度的简单构想,为规范地下空间开发活动提供法律依据。
Since modern times, with the rapid development of science and technology and the continuous improvement of urbanization in various countries in the world, the urban land resources have become scarce and precious day by day. Underground space has become a new area for the expansion of human life. Instead of being attached to the surface, Independent economic value and rights, Article 136 of China’s Real Right Law also clarifies the usufruct of underground space, but it is linked with the practice of development and utilization of underground space. At present, there are still loopholes and imperfections in the legislation. Starting from the rationality and scientificity of underground space right as real right, this article proposes a simple idea of establishing and perfecting the legal system, and provides a legal basis for regulating the development of underground space.
