国际专利强制许可制度是国际知识产权法中一项极具特色的对专利权进行权利限制的法律制度,它经历了三个不同的发展阶段:《保护工业产权巴黎公约》阶段、《与贸易有关的知识产权协议》阶段、《TRIPS协议与公共健康多哈宣言》与《关于多哈宣言第6段的执行决议》阶段,这一发展过程体现了国际知识产权制度中知识产权较多的国家(发达国家)和知识产权较少的国家(发展中国家)之间利益平衡点选择的变化。本文分析了上述法律文件产生的国际背景,并主要从有关具体规范入手,对国际专利强制许可制度中这两类国家之间利益平衡的嬗变作了深入的探讨。文章的意义在于以小见大、见微知著,通过对一项具体制度的研究,认识国际知识产权法演变与发展的方向和轨迹。
The international patent compulsory licensing system is a very special legal system in the international intellectual property law that restricts the rights of patent rights.
