物权法的颁布实施将对政府的行为产生三大影响:一是划定公权力界限。物权法对行政管理有很大影响。长期以来,在一些行政机关工作人员头脑中“无所不管”和“公权大于私权”的思想观念根深蒂固,没有考虑公权和私权还有界限。物权法明确物的归属和利用,划定了物上私权利的范围,从另一个侧面讲,也规定了行政机关及其工作人员公权力的界限。物权法实施以后,行政机关今后在行使公权力过程中,要充分树立物权观念和意识,注重和保护私人财产权,行政机关的工作人员也应当建立对各种合法财产平等保护的新物权观念。
Property law promulgation and implementation of the government's behavior will have three major effects: First, delineate the boundaries of public power. Property law has a great impact on the administration. For a long time, the ideological concepts of “omnipotent control” and “greater than private rights” in the minds of staff of some administrative organs have been deeply rooted. There is still no limit to considering public and private rights. The ownership and use of the definite property of the Real Right Law delineates the scope of the private right of the property. From another aspect, it also stipulates the limits of the public power of the administrative organ and its staff. After the implementation of the Property Law, the executive authorities in the process of exercising public authority in the future should fully establish the concept and awareness of real right, pay attention to and protect the private property rights, and the staff of administrative organs should also establish a new concept of real right for the equal protection of all kinds of legal property.
