为了保障外国驻中国的领馆在领区内代表其国家有效地执行职务,有利于对外开放和中外领事关系的发展,1990年10月30日第七届全国人民代表大会常务委员会第十六次会议通过了《中华人民共和国领事特权与豁免条例》,并经中华人民共和国主席于同日公布施行。这个条例的制定是很必要的,条例规定的内容也是基本可行的。在条例制定的过程中,争论较多的问题是领事官员享有豁免权是否只应限于执行职务的行为。条例第14条第1款规定“领事官员和领馆行政技术人员执行职务的行为享有司法和行政管辖豁免”。就是说原则上享有豁免权的只限于执行职务的行为,不包括执行职务以外的行为,这是适当的。因为《维也纳
