党的十八大报告指出,“加强社会建设,必须以保障和改善民生为重点”。因此,从立法上加强社会建设必须从以人为本、关注民生出发,以最广大人民的根本利益作为立法工作的初衷。从建设和谐社会角度来看,劳动关系的和谐是其重要内容,应让企业成为和谐劳动关系中的主动建设者,而非责任逃避者。西方某法律格言称:法律是最低限度的道德。又如温家宝总理所言,企业家身上要流淌着道德的血液。这种道德的血液就包括让劳动者更加体面和有尊严。由于我国市场经济是政府主导下的转型性市场经济,劳动关系具有的历史传承的复杂性更为突出。因此,研究当代中国民营企业劳资关系,不仅需要注重法律的影响,更不能忽略其他重要因素的存在,如劳资关系与企业文化的相互作用。企业文化是企业竞争力的来源,直接影响到企业的可持续发展,尤其是现代社会企业竞争异常激烈,企业文化直接决定了企业的发展走向。
The report of the 18th CPC National Congress pointed out: “In order to strengthen social construction, we must focus on safeguarding and improving people’s livelihood.” Therefore, from the angle of people-oriented and people’s livelihood, we must take the fundamental interests of the overwhelming majority of the people as the original intention of legislative work in order to strengthen social construction from the legislative point of view. From the perspective of building a harmonious society, the harmony of labor relations is an important part of it, and enterprises should be active builders in harmonious labor relations rather than responsible evasants. Some western legal aphorism: the law is the minimum moral. As Premier Wen Jiabao said, entrepreneurs should be flowing with moral blood. This moral blood includes helping to make workers more decent and dignified. Because China’s market economy is a transitional market economy led by the government, the complexity of historical heritage inherited from labor relations is even more prominent. Therefore, to study the relationship between labor and capital in modern Chinese private enterprises needs to pay attention not only to the influence of law, but also to other important factors such as the interaction between labor and capital and corporate culture. Corporate culture is the source of competitiveness of enterprises, which directly affects the sustainable development of enterprises. In particular, the competition of modern social enterprises is extremely fierce. Corporate culture directly determines the development trend of enterprises.
