原告:某乡政府。被告:苏某,男,25岁,某乡村民。原、被告于1989年3月15日签订了砖厂承包合同。合同载明:砖厂实行大包干;合同暂定一年;由承包人偿还发包方建砖厂时贷款233911.66元的贷款利息;合同公证后生效。但合同订立后未予公证。随后被告即组织生产。后因被告流动资金紧缺,原告于1989年7月、8月两次给被告担保从区、县财政借款25000元。这些借款,除原告留用1000元用于偿付建砖厂时个人投资外,其余均交由被告分配使用。同年9月,被告仍因流动资金困难自行停产。1990年6月双方协商终止了承包合同。后乡政府向法院提起诉讼,要求苏某清偿24000元借款,补交土地补偿费和承包期电费等5800元,两项共计29800元。被告苏某全部认承,但表示无力清偿。
Plaintiff: a township government. Defendant: Sumou, male, 25 years old, a rural villager. The original and defendant signed the brick factory contract on March 15, 1989. The contract states: brick and mortar large package dry; the contract is tentative for one year; by the contractor to repay the contractor brick factory loans 233911.66 yuan loan interest; the contract shall not become effective after notarization. However, the contract was not notarized. The defendant then organized the production. After the defendant’s liquidity shortage, the plaintiff twice in July 1989, August to the defendant secured from the district and county financial loans 25,000 yuan. Except for the plaintiff leaving 1,000 yuan to pay for the personal investment in building brick factory, the rest shall be distributed to the defendant for use. In the same year in September, the defendant still discontinued due to difficulties in liquidity. In June 1990, the two sides negotiated the termination of the contract. After the township government filed a lawsuit to the court, Sumou liquidated 24,000 yuan loan repayments, land compensation fees and contracting costs such as 5800 yuan, two total 29,800 yuan. Summou defend all defendants, but said unable to pay off.
