对违反学校规定或国家有关部门规定的教职工给予行政处分是法律赋予高校的一项自由裁量权,但这种行政处分过程和决定缺少工会的参与和救济。有权利就必有救济。随着依法治校日益成为大学治理的基本理念,赋予高校工会以处分救济权对维护职工利益有着重要的理论意义和现实价值。
The administrative sanctions imposed on the staff and workers who violate the provisions of the school or the provisions of the relevant state departments are a discretionary power granted by the law to colleges and universities.
