一稿多投现象背后有着深刻的社会基础,在一稿多投社会规制过程中,规制对象著作权人与新闻出版单位双方是平等的主体,他们之间不存在规制关系。在一稿多投社会规制的三个阶段中,初级规制阶段主要是道德规制,中级规制阶段主要是纪律规制和法律规制,高级规制阶段则主要是法律规制和技术规制。道德规制、纪律规制、法律规制和技术规制共同构成了一稿多投社会规制的四种方法。探索投稿群体分流、期刊淘汰竞争、发表权与出版权分离、电子出版与纸质出版分离等手段措施以缓解当前规制对象之间的矛盾和紧张关系。
There is a profound social basis behind the phenomenon of a manuscript. In the process of social regulation of manuscripts, there is no regulatory relationship between the subject of copyright and the press and publication unit. In the three phases of social regulation of a manuscript submission, the primary regulation stage is mainly moral regulation, the intermediate regulation stage is mainly the discipline regulation and legal regulation, while the senior regulation stage is mainly the legal regulation and the technical regulation. Ethical regulation, discipline regulation, legal regulation and technical regulation together form the four methods of social regulation of one manuscript vote.
