探矿权、采矿权转让是探矿权、采矿权人依法将探矿权、采矿权转移的行为,包括出售、作价出资、合作、重组改制等。探矿权、采矿权的出租、抵押,按照探矿权、采矿权转让的条件和程序进行管理,由原发证机关审查批准。各种形式的探矿权、采矿权转让,转让双方必须向登记管理机关提出申请,经审查批准后办理变更登记手续。采矿权人不得将采矿权以承包等方式转给他人开采经营。
