劳顾问:我单位有劳动合同制职工,1998年10月入厂,与单位签订的合同期至2001年10月止。1999年5月渐出现精神异常,8月份被市精神病医院诊断为精神分裂症,后入院治疗至今年1月20日出院,出院后病情仍有反复,我们又给他延长6个月的医疗期并为其治疗,但仍无法恢复原保安工作,另安排其做勤杂工也无法胜任。我们认为,该职工可享受的医疗期3个月已满,且给予延长的6个月的医疗期也已满,应该解除其劳动合同。我们的做法不知是否合法。请赐教!人民电机厂劳资科
