自2001年中国加入世界贸易组织以来,美国共发起了7起专门针对中国的特保案,韩国、日本、加拿大、美国、印度、土耳其和欧盟等7个世贸成员都对中国出口产品实施“特别保障条款”进行了国内立法。可见,我国国际贸易受到特别保障措施的影响之大,但是根据《中国入世议定书》和《中国加入工作组报告》,我国对“特定产品过渡性保障机制”的承诺有效期为12年,即于2013年失效。那么在“特保”效力终止的后,中国国际贸易又会遇到什么问题呢?美国等贸易大国是否有新的针对中国的贸易壁垒呢?这些问题将在本文中进行初步的探析。
Since China joined the World Trade Organization in 2001, the United States has launched a total of seven special safeguard cases targeting China. The seven WTO members such as South Korea, Japan, Canada, the United States, India, Turkey, and the European Union have all implemented “ Special Safeguards ”carried out domestic legislation. It can be seen that our country’s international trade is greatly affected by special safeguard measures. However, according to the “Protocol on China’s WTO Accession and the Report on China’s Participation in the Working Group,” China’s commitment to the “transitional guarantee mechanism for specific products” is valid for 12 years, that is, Expired in 2013. So what problems will China’s international trade face after the termination of the “special safeguard” effect? Whether the United States and other major trade countries have new trade barriers against China? These issues will be tentatively explored in this article.
