《广州市重大行政决策听证试行办法》规定现职公务员不得被选为听证代表,反映作为公众参与基本形式的听证制度的本质,有利于实现听证的目标、功能,体现了正当程序原则。同时具有很强的现实针对性,能够缓解当前听证会的公共信任危机,提高行政决策的可接受性,也并不阻塞公务员参与政策的渠道。这一举措虽然还不能解决听证制度实际运用存在的诸多弊端,却是朝着完善我国听证制度迈出了一步。
The Provisional Measures on Hearing for Major Administrative Decisions in Guangzhou stipulates that serving civil servants shall not be selected as representatives of the hearing, reflecting the essence of the hearing system as the basic form of public participation, which is conducive to the realization of the objectives and functions of the hearing and reflects the principle of due process. At the same time, it has strong realistic pertinence, can ease the crisis of public trust in the current hearing, enhance the acceptability of administrative decision-making, and does not block the channels for civil servants to participate in the policy. Although this measure can not solve the many shortcomings of the actual application of the hearing system, it is a step toward improving the system of hearing in our country.
