马强在《法学论证》2000年第2期上撰文论述了配偶权的有关问题。从配偶权是身份权，具有平等性、绝对性和支配性等特性来考虑，配偶权应当是指基于合法婚姻关系而在夫妻双方之间发生的、由夫妻双方平等专属享有的要求对方陪伴生活、钟爱、帮助的基本身份权利，应当派生出下列权利和义务：
