一、征集入选的广告语是否受著作权法保护审理著作权侵权纠纷案件,法院必须首先审查原告主张受著作权法保护的客体是否属于著作权法所规定的作品范畴。按照2002年9月15日施行的《中华人民共和国著作权法实施条例》第二条之规定,著作权法所称作品是指文学、艺术、科学领域内具有独创性并能以某种有形形式复制的智力成果。作品的独创性是指一部作品经作者独立创作产生,是作者独立构思的产物,而不是对已有作品的抄袭。判断作品是否具有独创性,应看作者是否付出了创造性劳动。作品的独创性与作品的文学、艺术、科学价值大小
