空间建设用地使用权是于离开地表的空中或地中横切一断层而设立的权利,在性质上属于土地空间权的一种形态及普通建设用地使用权的一亚种,具有重大的功用和价值。空间建设用地使用权的成立并不违背物权客体特定、一物一权及公示规则的要求。因其以划分土地上下的一定断层为标的(客体)而设立,故与以一宗(笔)土地的全体全层为标的(客体)而设立的普通建设用地使用权仅有量的差异。为应对土地立体化利用的社会需求及实现土地的物尽共用,同一土地上可同时设立空间建设用地使用权与以使用、收益为内容的其他用益物权。空间建设用地使用权的标的(空间)与土地的其他部分呈垂直邻接状态的调整,可由有关当事人通过约定相互间使用、收益的限制而获解决。此外,为完整、准确厘定空间建设用地使用权,还有必要厘清其与空中权、地中权及土地发展权的关联。
