形成于计划经济体制下的土地法律制度,无法满足市场经济条件下工业化和城镇化高速发展对土地的合理需求。云南省开始转变发展方式和用地方式,大胆尝试保护坝区农田与建设山地城镇,破解耕地保护与建设用地需求之间矛盾,走地方特色城镇化发展路子。云南省玉溪市和大理州的实践试验表明,“城镇上山”虽然存在诸多困难,但具有合理性与可行性。鉴于保护坝区农田与建设山地城镇的长期性与根本性,加强理论研究,创新法律制度,才是破解发展与保护“两难”的有效途径。
The legal system of land formed under the system of planned economy can not meet the reasonable demand for land under the conditions of industrialization and rapid urbanization in a market economy. Yunnan Province has started to change its mode of development and land use. It boldly tries to protect the farmland in the dam area and build mountain towns, break the contradiction between the protection of cultivated land and the demand for land for construction, and follow the path of urbanization with local characteristics. Practice tests in Yuxi and Dali prefecture of Yunnan Province show that although there are many difficulties in going up the hill in a town, it is reasonable and feasible. In view of the protection of farmland in the dam area and the long-term and fundamental nature of the construction of mountainous cities and towns, it is an effective way to crack down the development and protection of the “dilemma” by strengthening theoretical research and innovating the legal system.
