从现有的理论研究与司法实践看,相邻法律关系的主体应包括具有相邻关系的不动产的所有人、物权使用人和债权使用人以及利用不动产进行收益的主体和对不动产具有实际利用关系的无权利人。2007年《物权法》出台,虽为相邻关系的界定提供了新的法律依据,但具体到司法实践当中,还有许多新的问题有待进一步的研究与解决。
