目前,我国劳教所对经济利益的追求已经成为劳教工作的普遍现象。究其原因,就在于我国劳教执法机关中存在强劲的经济利益驱动机制。我们必须认识到,这种利益的驱动机制已经使劳教执法机关的公正执法,矫正教育受到了严重的阻碍。这种现象与劳教工作的性质,宗旨,任务,是格格不入的。它所带来的劳教人员超时劳动问题实际上违背了依法治国的政策,侵害了劳教人员的合法权益,侵占了劳教所的其他矫治改造活动的时间,破坏了劳教执法机关的形象,导致劳教矫正手段的异化和错位等等。本文认为对劳教人员超时劳动问题的提出是无法回避的,并在其基础上提出一些对策希望对这一问题的解决有所帮助。
At present, the pursuit of economic interests by China’s labor camps has become a common phenomenon in labor camps. The reason is that there is a strong economic interest-driven mechanism in China’s labor-reform law-enforcement agencies. We must realize that this kind of interest-driven mechanism has seriously hampered the fair law enforcement and corrective education of the labor-for-justice law enforcement agencies. This phenomenon is incompatible with the nature, purpose and tasks of reeducation through labor. The overtime work it has brought has in fact violated the policy of governing the country according to law, infringed upon the lawful rights and interests of reeducation-through-labor personnel, invaded other corrective and corrective activities in labor camps, undermined the image of law enforcement agencies in labor camps, Alienation and misalignment of means and so on. This paper argues that it is unavoidable to put forward the issue of overtime labor for reeducation-through-labor and proposes some countermeasures on the basis of which it hopes to help to solve this problem.
