劳动教养:聆询制度的价值、原则、缺失与完善

目前,劳动教养聆询制度已经在全国推行。劳动教养聆询属于广义上的听证程序,又是一种“准司法审判程序”。其价值主要体现为平衡、平等、公正、效率和廉政,对中国社会主义民主和法治建设起了积极的作用,具有重要的理论价值和现实意义。劳动教养聆询制度遵循公开、公正、职能分离和事先告知等原则,其在实践方面尚存在原则要求、根本目的、价值宣传和程序作用等缺失。为此,全社会应加大聆询宣传力度,增强民警人权意识,保证聆询公正透明,并建立聆询效力制度。 At present, the reeducation through labor system has been implemented throughout the country. Reeducation through labor hearing belongs to the hearing procedure in a broad sense and is also a “quasi-judicial trial procedure.” Its value is mainly manifested as balance, equality, fairness, efficiency and integrity. It plays a positive role in building socialist democracy and the rule of law in China, and has important theoretical and practical significance. The system of reeducation through labor follows the principles of openness, fairness, separation of functions and advance notification. There are still some principle requirements in practice, such as the lack of fundamental purpose, value publicity and procedural functions. Therefore, the whole society should step up its consultation and advocacy efforts, enhance the awareness of human rights of the police, ensure fairness and transparency in the hearing, and establish a system of effective rules for the hearing.
