随着我国人口的增多,受教育程度的逐步提高,以及就业形势的日益严峻,劳动合同的签订与效力问题也日益受到人们的关注。但是,目前我国劳动合同无效制度存在诸多悖论与缺陷,给用人单位、劳动者以及其他相关人员造成了困扰。本文着重分析了目前劳动合同无效制度中存在的问题,反思现行制度的缺陷,对合同无效制度的重构进行探讨,从而使劳动合同无效制度更加完善,推动我国劳动合同制度的发展。
With the increase of population in our country, the gradual increase of education level and the increasingly serious employment situation, the signing and effectiveness of labor contracts are also receiving more and more attention. However, at present, there are many paradoxes and defects in the system of invalidation of labor contracts in our country, which plague employers, laborers and other related personnel. This article analyzes the existing problems in the current labor contract invalid system, reviews the defects of the current system and discusses the reconstruction of the invalid contract system so as to make the labor contract invalid system more perfect and promote the development of the labor contract system in our country.
