在世界范围内,电子商务法的立法活动不过是近几年的事。如果以联合国的《电子商业示范法》(本文以下简称《示范法》)的颁布作为国际范围内立法的标志,那么至今也仅有六、七年的历史。其间,有关电子商务的立法原则已经初见端倪,它们包括最小程度原则、程序性原则、功能相等原则、技术中性原则、当事人意思自治原则和国际协调性原则。本文对这些原则做一简单对比和讨论。
In the world, the legislative activities of the e-commerce law are but things in recent years. If the United Nations Model Law on Electronic Commerce (hereinafter referred to as the “Model Law”) is promulgated as a mark of international legislation, it is still only six or seven years old. In the meantime, the legislative principles concerning e-commerce have taken shape. They include the principle of minimum, the principle of procedure, the principle of equal function, the principle of technical neutrality, the principle of party autonomy and the principle of international coordination. This article makes a simple comparison and discussion of these principles.
