唐律是我国古代封建律法的典范,其中规定的许多法律原则和法律制度对我国现行法律制度的完善和发展仍然具有参考和借鉴价值。正如张晋藩教授所评价的那样:“唐律是中国古代礼法结合的典范,剖析唐律是有助于鉴古明今的。”因而研究唐律,是非常有必要的。正是出于这样一种研究目的,本文对唐律中的藏匿罪进行了详细的考察和细致的分析,以期对我国现行刑法中窝藏、包庇罪的完善有所借鉴。
Tang law is a model of the ancient feudal law in our country. Many of the legal principles and legal systems stipulated therein still have reference and reference value for the perfection and development of our country’s legal system. As Professor Zhang Jinfan commented: “The Tang law is an example of the combination of ancient etiquette and ritual in China, and the analysis of the Tang ritual is of great help to the ancient and modern times.” Therefore, it is very necessary to study the law of the Tang Dynasty. It is for such a research purpose, this article conducted a detailed investigation and careful analysis of the crime of concealment in the law of Tang Dynasty in order to draw lessons from the perfection of harboring and harboring crime in the current criminal law in our country.
