卡夫卡的《在法之前》和《在苦役营》为巴特勒的律法述行思想提供了理论试验场。《在法之前》揭示了律法通过空间上的不在场和时间上的无历史隐藏了其对主体的述行功能。《在苦役营》则直观地体现了律法对身体的铭刻,也表明身体的毁灭是律法得以产生和继续的代价。这两个短篇小说体现了律法述行“寻找/隐藏”的叙事策略,也体现了律法述行的不变性和可变性。不变性指向抽象之法,可变性则指向具体之法。后者为巴特勒提供了一个颠覆的领域。律法述行与文学叙事在巴特勒的理论中形成一种互文关系,这种互文关系可以进一步说明律法及其述行的虚构性。
Kafka’s “before the law” and “in the camp” provided the theoretical test ground for Butler’s thinking on the law. “Before the Fa” reveals that the law hides its narrative function of the subject through the absence of space and the absence of time. Camp in Hardship shows the inscription of the law on the body intuitively and shows that the destruction of the body is the price at which the law can be created and continued. These two short stories embody the narrative tactics of “finding / hiding” in the law as well as the invariance and variability of the law. Invariance refers to the law of abstraction, while variability refers to concrete law. The latter provided Butler with a subversive field. The introduction of the law and the literary narration form a kind of intertextual relationship in Butler’s theory, which can further explain the fictionality of the law and its deeds.
